CONTRACTS

The value of a properly drafted contract should never be underestimated. The contract protects the rights of the parties involved and directs their individual expectations. Legally, all employers must provide their employees with written particulars of employment (Basic Conditions of Employment Act). We use a contract not only to comply with this statutory requirement, but also to protect the interest and the rights of employers. Our contracts comply with labour legislation and also reflect case law that protects the rights of employers.  We also have uniquely drafted clauses in the contract that comes from many years of experience in the Labour Law and HR discipline.

We specialize in the drafting of contracts for employees, fixed term employees, domestic employees, independent contractors and freelance workers. DISCIPLINARY | POOR WORK PERFORMANCE INQUIRIES

Legally, no employee’s services may be terminated for misconduct or poor work performance, unless the proper procedures have been followed and the decision to dismiss is fair given the circumstances. Often a fair procedure requires that an objective, external Chairperson presides over the inquiry to ensure procedural fairness. As competent and objective Presiding Officers we assist companies to Preside over inquiries ensuring fair procedures and decisions. Perceived unfairness is the primary reason employees refer a case to the CCMA / Bargaining Council. We pride ourselves therein that over the years we have proven that our legally compliant and sound procedures and decisions result in limited CCMA / Bargaining Council referrals.

We also offer in-house training for companies who wish to train in-house Presiding Officers to ensure that the proper procedures are followed and that decisions are fair, consistent and in line with company policy and legislation. We also offer in-house training for company Initiators or Prosecutors that will present the company’s case during the inquiry. Our services also include the drafting of proper, legally sound Disciplinary and Poor Work Performance Policies and Procedures.
